Daffy Apple Trademark

The Daffy Apple™ Company and Daffy Apple product line was founded in Illinois in 1951 by George Leslie Smith. The Daffy Apple trademark was originally issued to Prepackage Sales, Inc. of Rock Island Illinois, a company owned by George Leslie Smith in August 1953.  George moved the Daffy Apple operations to Denver, Colorado and began to set up a Daffy Apple franchise system.  Golden Creme Donut Company and Adam's Syrup Company were a couple of the local franchise operators in Denver.
 
Daffy Apple or "Daffy Apple Company" was never started or owned by any other company outside of either Illinois or Colorado.  The trademark is currently owned by Daffy Apple Corp of Denver, Colorado.  The trademark currently has both section 8 and 15 filings for continued use and incontestable status.
 
Daffy Apple Corp completed a round of lengthy depositions with the United States Trademark and Patent Office's Trademark Trial Appeal Board to rightfully stop the use of the Daffy Apple tradename by California Snack Foods, Inc, a California company who was unrightfully stating a claim to the name.  RE: Daffy Apple Corp. v. California Snack Foods, Inc.  See Trademark Trial and Appeals Board Opposition Number 106,065.  Daffy Apple Corp prevailed in the outcome as California Snack Foods had no claim to the trademark.
